TERMS AND CONDITIONS:

The following terms cover Occupancy Agreement between Childhood Cancer Association and the Client named on this document.

  1. Liability of Usage: The Client agrees to indemnify Childhood Cancer Association from and against all costs, claims, liabilities and expenses that arise from staying at Bradley’s Place including but not limited to claims by third parties as a result of personal injury or property damage. Childhood Cancer Association will not be held liable for any injury, loss or damage sustained by the Client during the use of the property.
  2. COVID-19 Waiver: While every effort has been made to ensure the hygiene of Bradley’s Place, the Childhood Cancer Association holds no responsibility for any claims of illness. Staying at the property is conducted at the risk of the Client and acceptance of such is a condition of staying at the house. We do not accept any responsibility for any risk that may occur from staying at Bradley’s Place or the use of the vouchers provided (Urimbirra and the Victor Harbor Farmers Market). This is done at your own risk.
  3. Cancellation Policy: The Client will ensure that if they need to cancel their scheduled stay at the property, they will provide at least 14 days notice to the Association. Failure to provide sufficient notice of cancellation to the Childhood Cancer Association may affect The Client’s ability to obtain future stays at the property.
  4. Maintenance of the Property: The Client will ensure that the property is maintained and that no unauthorised alterations or repairs to the property will be made. If repairs or alterations are needed the Client must contact the Childhood Cancer Association as soon as possible on (08) 8239 2211.
  5. Repairs and Replacement of Property: By signing this Contract the Client agrees to pay the cost of repairing or replacing property should any damage other than normal “wear and tear” occur during the period of occupancy. If any property is lost or destroyed by the Client or any guest of the Client, the Client is liable to pay the full cost of replacement unit/s. This should be reported to the Childhood Cancer Association.
  6. Cleaning: It is expected that each Client cleans the property beforedeparture. The Client accepts that should the property be left in an unfit state whereby it requires additional cleaning to that which usually occurs after a stay, the Client will incur a cleaning charge. A cleaning fee of $250 will be applied, depending on the number of additional hours of cleaning required. The client will adhere to the vacating property checklist which specifies the requirements regarding cleaning of the property prior to departure.
  7. Ownership: nothing in this agreement is to be taken as implying in any way whatsoever that the relationship of landlord and tenant exists between the Childhood Cancer Association and the Client
  8. Access to the Property: It is expected that the Client will permit the Association, its contractors and agents to enter the property at any time to inspect the state and condition of the house and its furnishings, fittings and equipment.
  9. Returning Equipment: It is the Client’s responsibility to return the keys to the designated location as soon as the property is vacated.
  10. Liability of Costs Incurred: The Client and /or Signatory of this Contract is liable for all costs incurred by or arising from this contract.
  11. Change of Address: The Client will advise the Childhood Cancer Association as to any change of permanent address within 14 days.
  12. Other Terms of Occupancy:
    1. It is expected that no more than eight persons who are immediate family members only will occupy the house at any one time, unless prior approval has been granted
    2. To pay all non-emergency related telephone costs
    3. No pets will be permitted in the house or on any part of the premises
    4. Smoking is strictly not permitted in the house
    5. There is a strict no party policy
    6. There will be at least one responsible CCA member client adult (aged 25+ years) at the property at all times
    7. Bradley’s Place is for immediate family only, no guests are allowed

Any person or persons not abiding by the conditions and guidelines set out above, may place any future opportunities to utilise the said property at risk. Should this be the case they will be advised in writing by the Association.
